1 - PRESENTATION:
SitbBid.com is owned by RB Interactive Ltd. (Company N° 7007542), hereinafter referred to as SitnBid, SitnBid.com, We, Website or Site.
SitnBid.com is an online game site based on the blind downward bidding auction system. It allows participants to compete in auctions where the winner is the participant who placed the lowest unique bid, in compliance with the General Terms and Conditions and according to the Rules of Use specified hereunder.
2 - DEFINITIONS:
Reverse auction (lowest unique bid auction): a game in which the participant who placed the lowest unique bid is acknowledged to be the winner of the game.
Bid or Offer: the price or prices offered by the participants.
Winner: the participant designated by the system as having placed the lowest unique bid.
Credits: the currency specific to the SitnBid.com site. Credits enable participants to take part in the reverse auction game featured on our site. Credits can be exchanged for gifts from our online store.
Auction home page: the insert located on the Sitnbid.com home page and containing full information on the auction (duration, winnings, requisite number of participants, entry fee, administration fee).
Username and password: the username and password previously chosen by the customer when he or she registered on the site.
You, Your: refers to the user of the service.
Registration fee or Entry fee: the amount deducted from the user’s account when he or she registers to participate in a reverse auction.
Administration fee: the amount deducted from the user’s account when he or she registers to participate in a reverse auction, and which is additional to the registration fee. This amount is the equivalent of 10% (ten per cent) of the registration fee for an auction. For example: Registration fee = 0.50 Credits, therefore Administration fee = (10/100)*0.50 = 0.05 Credits. This fee covers the cost of managing and organizing reverse or inverted auctions.
Bid package: the number of bid opportunities the participant receives in exchange for his registration fee. These enable participants to place bids with a view to winning the auction. For example: after paying their registration fee and administration fee, the participants of an auction each receive a package of 50 bid opportunities. Each participant can therefore place 50 bids or offers during the auction.
The Site: the SitnBid.com website.
3 - REGISTRATION:
Each user accessing this site must be aged 18 (eighteen) years or over, or have reached the legal age of majority in his or her country of residence.
Each user, by registering on SitnBid.com, accepts unconditionally and without exception the following prohibited uses
• Opening and using more than one account.
• Using a false or misleading address or e-mail address.
• Providing false or misleading information.
• Using names and/or addresses and/or personal data of any kind belonging to third parties.
• Abusing promotions or bonuses or special offers (opening, closing, then again opening a user account in order to repeatedly take advantage of registration bonuses for example, abuse or fraud concerning the Refer a Friend scheme).
• Using or attempting to use the reverse auction game in a collusive manner. Collusion (or connivance) takes place when two or several players participate in the same session and try to gain an unfair advantage by sharing information on the placing of bids they have made or are going to make
• Using or attempting to use software or any other means not implemented by SitnBid.com in order to facilitate winning one or several auctions.
• Using or attempting to use several different Internet browsers or several different tabs within the same Internet browser to participate in the same auction in order to be able to place series of bids over and above the 5 bids currently authorized. In fact, since each series placed by a player triggers an automatic page refresh, too short a time between two series could be interpreted by our services as an attempt to defraud.
Should SitnBid.com consider that You have not respected the rules outlined above, SitnBid.com reserves the right to definitively ban the user or users concerned, which will result in the total and definitive loss of the amounts having been deposited in the account or accounts of guilty users.
Certain legal jurisdictions have not addressed the legality of online reverse auctions. Use of the SitnBid.com website is in no case intended for persons for whom such use would be illegal. The availability of our website should in no case be interpreted as an offer or an invitation on our part to use online reverse auctions in a country where such use is illegal. It is your responsibility entirely to inform yourself of the laws in force in your jurisdiction to ensure that your use of our reverse auctions is entirely legal in the country where you reside and in the country where you connect to the Internet. You are subject to all laws of the city, state, federal, province and/or country in which you reside and from which you access the Site and are solely responsible for obeying those laws. Access to the Site may not be legal for some or all residents of, or persons present in, certain jurisdictions. You agree SitnBid.com cannot be held liable if laws applicable to you restrict or prohibit your participation. SitnBid.com makes no representations or warranties, express or implied, as to the lawfulness of your accessing the Site or participating in any auctions, products or services offered by or through the Site, nor shall any person affiliated, or claiming affiliation, with SitnBid.com have authority to make any such representations or warranties.
SitnBid.com reserves the right (but has no obligation to you) to monitor the location from which you access the Site and to block access from any jurisdiction in which participation or access is illegal or restricted. SitnBid.com may require any participant receiving any prize to provide the Site with proof that he or she is, or was at the time the subject auction was played, eligible to participate according to the Terms and Conditions. Without limiting any contrary provision of the Terms and Conditions, if SitnBid.com monitors your access or participation on the Site, SitnBid.com shall not be liable for the effectiveness of such monitoring. By accessing, using, or downloading in any way any materials on the Site, or merely browsing the Site, or creating an account and/or participating in any auction or service offered by or through the Site, you represent and warrant that you are doing so in compliance with the Terms and Conditions and agree to indemnify and hold harmless SitnBid.com for any liability, claims, and damages (including attorneys' fees) arising out of or related to your violation of the Terms and Conditions.
SitnBid.com reserves the right to deactivate the accounts of users who have not logged in to this service for a period over or equal to 18 (eighteen) months.
4 - CONNECTING TO THE SITE:
When registering on the SitnBid.com site, each user must choose a login name (nickname), which will be the sole and unique name for identifying the user on the site. Each user must also choose a password. If you are a user on the SitnBid.com site, your login name and your password will allow you to see, use and manage your account. You are solely responsible for keeping your login name and password confidential. In no case and in no way will SitnBid.com or its employees or associates have responsibilities, obligations or duties with regard to the use or improper use of your login name and/or password
5 - SERVICE:
Our Service is limited to making available reverse or inverted auctions, to monitoring the proper execution of the game based on the style of reverse or inverted auctions and to offering the possibility for users to obtain any awards thus generated, according to the Rules of Use specified below. In addition, the SitnBid.com Service includes the management and updating of the site and of its web pages and software, as well as the management of all costs related to servers, employees, advertising and all costs related to the management of a company. You hereby agree and accept that the Service offered and for which you decide to buy Credits is reasonable. Users who wish to participate in the auctions agree to buy Credits for these services. IF, FOR WHATEVER REASON, YOU DO NOT AGREE WITH THE SERVICE WE OFFER, PLEASE DO NOT REGISTER ON OUR SITE AND DO NOT TAKE ADVANTAGE OF OUR SERVICES.
6 - CREDITS:
a) Purchasing Credits:
Access to the site and registration are free. To use and benefit from the services offered by SitnBid.com, you must buy Credits. These Credits allow you to pay the registration fee and administration fee. The amount of Credits that you have bought and which is deducted from your user account to participate in a reverse auction can vary from one auction to another.
b) Refunds:
Once the purchase of your Credits has been validated, no request for a refund will be accepted.
7 - BONUS OFFERS:
When you are purchasing Credits, or in the case of promotions which may be presented from time to time, SitnBid.com may, at its own discretion and with no obligation whatsoever, offer you bonus Credits. Any awards obtained by using your bonuses can be used only in the SitnBid.com store. SitnBid.com reserves the right, at any time, to withdraw from its offers any bonus, promotion or any other special offer. Bonuses are credited automatically within 24 (twenty-four) hours.
All bonuses are subject to the terms and conditions of use that were in force when the offer was made.
8 - SERVICE CONTINUITY:
SitnBid.com can, with or without prior notice, reserve the right to modify or interrupt all or any part of the Service. These modifications or interruptions can be temporary or permanent. You agree and accept that SitnBid.com can neither be held responsible nor be liable to any sanction or measure on your part or on the part of a third party on the grounds of a modification or interruption of the Service. You agree and accept that no refund will be made except in the case of permanent interruption of the Service for a continuous period of 12 (twelve) consecutive months.
9 - OPERATING PRINCIPLES OF THE SITNBID.COM SITE:
SitnBid.com offers registered users several types of game based on the blind downward bidding auction principle. Conditions of use for these games are listed below. We reserve the right at any time to suspend, modify or add a type of game on the site.
Start and end of the auction :
a) SitnGo auctions:
Each auction begins as soon as the requisite number of participants has been reached. The requisite number of participants is displayed on the auction home page. As long as this number has not been reached, the auction remains in waiting mode for new participants. As soon as the requisite number of participants has been reached, the auction begins and lasts 20 (twenty) minutes. A countdown is displayed showing the time remaining before the auction ends. The auction is over once the countdown reaches 0 (zero) seconds.
b) Scheduled auctions:
Each auction begins on the date and at the time shown on the auction home page. The minimum or maximum number of participants is displayed on the auction home page. If the minimum number of participants has not been reached on the date and at the time the auction should start, the auction is postponed for 24 hours. If the maximum number of participants is reached before the scheduled start date and time of the auction, registrations are then closed. Each auction lasts 20 (twenty) minutes. A countdown shows the time remaining before the auction ends. The auction is over once the countdown reaches 0 (zero) seconds.
Cost of the auction:
The cost of the auction is displayed on the home page of each auction. This cost is composed of 2 (two) amounts: Registration fee and Administration fee. The amount of the Administration fee is equal to 20% (twenty per cent) of the amount of the Registration fee. This Administration fee covers the cost of managing and organizing reverse or inverted auctions. For example: Registration fee = 0.50 Credits, therefore Administration fee = (20/100)*0.50 = 0.10 Credits. So on the home page, the cost of the auction will be displayed as follows: Registration fee: 0.50 Credits, Administration fee: 0.10 Credits.
Auction procedure:
Once the requisite number of participants has been reached, the auction begins. The registration fee drawn from the user’s account enables him or her to obtain a bid package. Each participant receives the same package and thus the same number of bid opportunities. The number of bid opportunities contained in each package is shown on the auction home page. Each participant is free to use or not to use all his or her bids. Any bids left unused are lost and can in no circumstances be used in another auction.
Validity of bids:
Bids must be expressed to two decimal points (for example 1.23). Bids therefore start at 0.01. They can be placed via the fields provided for this purpose.
Each bid is valid as soon as it is registered by SitnBid.com. A delay may occur between the moment when the bid is placed and the moment when the bid is registered by SitnBid.com. The user may also encounter connection problems which cause a delay in registering the bid.
To be considered valid, each bid must be registered during the period when the auction is open. We advise you to take care because bids placed in the very last seconds are liable not to be registered before the end of the auction and, in this case, will be considered invalid. When a bid is registered, it appears on the screen together with its status.
The automatic page reload function is designed to help prevent possible overloads as regards your computer’s CPU usage.
The winner:
The participant who, at the end of the auction, has placed the lowest unique bid, is designated by SitnBid.com as being the winner of the auction, and is awarded the registration fees of all the other participants. The winner is in no circumstances obliged to pay out the amount of his or her bid to be able to receive these winnings on his or her user account. Placing the lowest unique bid means placing the bid closest to 0.01 and being the one single person to have placed this bid.
10 - CANCELLATION OF AN AUCTION:
When an auction has ended, if our services detect a case of fraud, of cheating by collusion or by any other process, of malfunction of the system or of the software, the auction will then be declared invalid. In such a case, all the participants, except of course the cheats, will have their registration fee refunded within 24 hours of the time when our services detected the auction to be invalidated. Since the administration fees represent the cost of managing the auction, these fees will in no circumstances be refunded.
SitnBid.com reserves the right to modify the conditions for claims, for cancelling an auction and the consequences of such a cancellation.
11 - PARTICIPATION IN SEVERAL AUCTIONS:
You can participate in several auctions simultaneously. However, participation by one player in too many auctions simultaneously may result in game slowdown on this player’s computer. SitnBid.com declines all responsibility for any problem or technical malfunction resulting from this kind of use of our reverse auction service.
12 - REFERRING A FRIEND:
The Refer a Friend bonus is subject to the following conditions:
• The people you refer must be real individuals whom you know and who accept this invitation in the spirit in which is was intended.
• A person can only be recommended by one single user of SitnBid.com.
• Any attempt to defraud or abuse the spirit of the Refer a Friend scheme in any way whatsoever will result in the user’s being banned from the site and the total loss of credits remaining in the account.
13 - COLLECTING AWARDS:
The SitnBid.com store is accessed via the “Store” menu on the website home page. In the store you will select an item from our catalogue. Your account will then be debited the number of Credits corresponding to the price of the item selected. Your order will be processed within 7 (seven) days of receipt of your order by our services.
14 - DELIVERY:
All lots won on SitnBid.com are sent in the form of gift cards or gift checks for the value of the lot that has been won. These gift cards or gift checks will be sent to the e-mail address provided by you when registering, and will be completed with the last and first names you also provided when registering. The use of gift cards or gift checks is subject to the general terms and conditions of the retail website that has issued these gift cards or gift checks.
15 - PUBLICATION OF WINNERS:
SitnBid.com has the right to publish information on the winner at the end of each auction (login name and town of residence).
16 - DISCLAIMER:
SitnBid.com, including its legal representatives, administrators, directors, agents, affiliated companies and employees, shall not be held liable for incorrect or incomplete content published on the site or concerning the Service, whether generated by visitors, users or by any instrument, equipment or program associated with the Service or used in the Service, whether deriving from the conduct of any visitor and/or user of the Service either online or offline. SitnBid declines all responsibility for any errors, omissions, interruptions, deletions, defects, delays in operation or in transmission, lack of communication lines, theft, destruction or unauthorized access to, or alteration of, communications of visitors and/or users. SitnBid.com shall not be liable for any problem or technical malfunction of any telecom network or telephone line, online computer system, server or Internet access provider, computer hardware, software, e-mail deficiency or traffic congestion on the Internet or any site or combination of these, including any prejudice or damage to visitor and/or user computers and/or computer of any other person or which is the result of participating or downloading material related to the SitnBid.com site and/or Service. Each participant receives the same package and thus the same number of bid opportunities. The number of bid opportunities contained in each package is shown on the auction home page. Each participant is free to use or not to use all his or her bids. Any bids left unused are lost and can in no circumstances be used in another auction.
Validity of bids:
Bids must be expressed to two decimal points (for example 1.23). Bids therefore start at 0.01. They can be placed via the fields provided for this purpose.
Each bid is valid as soon as it is registered by SitnBid.com. A delay may occur between the moment when the bid is placed and the moment when the bid is registered by SitnBid.com. The user may also encounter connection problems which cause a delay in registering the bid.
To be considered valid, each bid must be registered during the period when the auction is open. We advise you to take care because bids placed in the very last seconds are liable not to be registered before the end of the auction and, in this case, will be considered invalid. When a bid is registered, it appears on the screen together with its status.
The automatic page reload function is designed to help prevent possible overloads as regards your computer’s CPU usage.
The winner:
The participant who, at the end of the auction, has placed the lowest unique bid, is designated by SitnBid.com as being the winner of the auction, and is awarded the registration fees of all the other participants. The winner is in no circumstances obliged to pay out the amount of his or her bid to be able to receive these winnings on his or her user account. Placing the lowest unique bid means placing the bid closest to 0.01 and being the one single person to have placed this bid.
10 - CANCELLATION OF AN AUCTION:
When an auction has ended, if our services detect a case of fraud, of cheating by collusion or by any other process, of malfunction of the system or of the software, the auction will then be declared invalid. In such a case, all the participants, except of course the cheats, will have their registration fee refunded within 24 hours of the time when our services detected the auction to be invalidated. Since the administration fees represent the cost of managing the auction, these fees will in no circumstances be refunded.
SitnBid.com reserves the right to modify the conditions for claims, for cancelling an auction and the consequences of such a cancellation.
11 - PARTICIPATION IN SEVERAL AUCTIONS:
You can participate in several auctions simultaneously. However, participation by one player in too many auctions simultaneously may result in game slowdown on this player’s computer. SitnBid.com declines all responsibility for any problem or technical malfunction resulting from this kind of use of our reverse auction service.
12 - REFERRING A FRIEND:
The Refer a Friend bonus is subject to the following conditions:
• The people you refer must be real individuals whom you know and who accept this invitation in the spirit in which is was intended.
• A person can only be recommended by one single user of SitnBid.com.
• Any attempt to defraud or abuse the spirit of the Refer a Friend scheme in any way whatsoever will result in the user’s being banned from the site and the total loss of credits remaining in the account.
13 - COLLECTING AWARDS:
The SitnBid.com store is accessed via the “Store” menu on the website home page. In the store you will select an item from our catalogue. Your account will then be debited the number of Credits corresponding to the price of the item selected. Your order will be processed within 7 (seven) days of receipt of your order by our services.
14 - DELIVERY:
All lots won on SitnBid.com are sent in the form of gift cards or gift checks for the value of the lot that has been won. These gift cards or gift checks will be sent to the e-mail address provided by you when registering, and will be completed with the last and first names you also provided when registering. The use of gift cards or gift checks is subject to the general terms and conditions of the retail website that has issued these gift cards or gift checks.
15 - PUBLICATION OF WINNERS:
SitnBid.com has the right to publish information on the winner at the end of each auction (login name and town of residence).
16 - DISCLAIMER:
SitnBid.com, including its legal representatives, administrators, directors, agents, affiliated companies and employees, shall not be held liable for incorrect or incomplete content published on the site or concerning the Service, whether generated by visitors, users or by any instrument, equipment or program associated with the Service or used in the Service, whether deriving from the conduct of any visitor and/or user of the Service either online or offline. SitnBid declines all responsibility for any errors, omissions, interruptions, deletions, defects, delays in operation or in transmission, lack of communication lines, theft, destruction or unauthorized access to, or alteration of, communications of visitors and/or users. SitnBid.com shall not be liable for any problem or technical malfunction of any telecom network or telephone line, online computer system, server or Internet access provider, computer hardware, software, e-mail deficiency or traffic congestion on the Internet or any site or combination of these, including any prejudice or damage to visitor and/or user computers and/or computer of any other person or which is the result of participating or downloading material related to the SitnBid.com site and/or Service. In spite of any element contrary to what is indicated in the present agreement, the liability of SitnBid.com towards the user for whatever reason, and whatever the form of action, will in any case be limited to and not exceed the amount paid by the user, and expressed in Credits still unused, net of any free Credits received.
